SIMONS, District Judge.
Suit upon an insurance contract issued under the War Risk Insurance Act. From judgment for plaintiff upon verdict, defendant appealed.
Appellee entered the army May 12,1917, was commissioned second lieutenant on August 16th of the same year, and discharged as first lieutenant November 30,1918, by reason of demobilization. While in the military service of the United States, he was granted a contract of war risk term insurance in the sum of $10,000, payable to him in monthly installments of $57.50 in the event he became permanently and totally disabled while the contract…
