This appeal is from a judgment in the district court of Dallas county adverse to appellants, who had sued appel-lees for an indebtedness of $25,608 alleged to have been due the firm of Wagner & Don-ley Bros, for the drilling of wells Nos. 4 and 5 on a tract of 94 acres of land in Eastland county. Appellants asserted a one-half interest in said indebtedness, and sought to recover the other one-half interest for the estate of their then deceased partner, Wagner.
