Plaintiff appeals from a judgment sustaining a motion of lis pendens and dismissing his suit.
The facts upon which the action of the trial court was based may be briefly stated. This action by the husband against the wife for a separation a mensa et thoro, predicated upon the ground of their living separate and apart for more than a year, was filed in the First Judicial District Court for Caddo Parish, Louisiana, on May 14, 1971.
