This action was brought to cancel a life insurance policy on the ground of fraud.

December 16, 1938, the plaintiff, the West Coast Life Insurance Company, issued a policy of life insurance to one Dino Mori in the sum of two thousand dollars. The policy named Thelma Mori, the wife of the insured, as beneficiary.

December 14, 1940, the insurance company commenced an action in the superior court of the state of Washington, for King county, against the insured and his wife, seeking a cancellation of the policy, for the reason, as alleged, that Mr. Mori fraudulently represented his previous…
