Relators John Hilker and AlliedSignal, Inc. seek a writ of prohibition to prevent Respondent from proceeding to trial in a wrongful death case brought against them by Murlene and Sonja Saffle. As grounds for the writ, Relators claim that the trial court exceeded its jurisdiction by sustaining the Saffles’ motion for leave to amend their petition to add the Relators as parties defendant. Relators offer two reasons to support their claim: 1) the Saffles had dismissed their lawsuit altogether before the court ruled on the motion for leave to amend, and 2) the statute of…
