(dissenting) — There appearing to me no basis in law or equity for the taxing of attorneys’ fees against the state, and no appropriation with which to pay them, and no sanction whatever either in the rules or statutes for the method adopted by the court in this case to determine the amount allowed, I dissent.

Petitioners, as citizens and taxpayers, earlier brought a writ of prohibition to prevent the disbursement of public money appropriated by the legislature and approved by the Governor to apply toward the tuition of needy children attending private and parochial schools and for students…
