— Appeal from an order of the Supreme Court at Special Term (Cobb, J.), entered July 14, 1982 in Albany County, which granted defendant’s motion for summary judgment dismissing the complaint. Defendant, an attorney, was retained to represent plaintiff on April 16, 1981 in connection with criminal charges levied against plaintiff regarding his conduct in the operation of a motor vehicle which caused the death of a third person.
