Judgment was rendered in the trial court on April 12, 1926. On April-15, 1926, motion for new trial was filed, and on the same day the motion for new trial was overruled. This appeal was lodged in this court on October 14f1926, by filing petition in error with ease-made attached.. Defendant in error has filed his motion to dismiss the appeal for the reason the certificate of the trial judge settling case-made and his signature thereto is not attested by the court clerk and the seal of the court attached.
