Appellant, plaintiff below, brought this suit in the Circuit Court of Buchanan County seeking to recover a one-half interest in the personal property of the estate of Edward Mark Ray, deceased. The personal property of the estate is valued at approximately $96,000. Edward Mark Ray died "without any child or other descendants in being capable of inheriting" and appellant alleging herself to be the widow of the deceased bases her claim to one-half of said personal property upon what is now Section 325, Revised Statutes 1929.
