BRICKEN, Presiding Judge.

From the judgment entry in this ease we ascertain that this appellant was tried and convicted, on the 6th day of February, 1934, for the offense of murder in'the second degree, and his punishment was fixed by the jury at twelve years’ imprisonment; whereupon, the court sentenced him to serve twelve years’ imprisonment in the penitentiary. From the judgment of conviction this appeal was taken.

This appeal was taken under the provisions of chapter 74 of the Code of Alabama 1923 (section 3234 et seq.); and in cases of this character the duty devolves upon this court to…
