This action originated in a demand presented to the board of supervisors of Arlington county for payment of a debt alleged to be due by the county. The claim was stated thus:

“Arlington county, Virginia, is justly indebted to American-LaFrance and Foamite Industries, Incorporated, in the sum of thirty-four thousand seven hundred forty-two dollars ($34,742) principal and four thousand eight hundred forty-seven dollars and forty-nine cents ($4,847.49) interest, being the balance due on the purchase price of fire fighting apparatus and equipment sold and delivered to the said county by the said…
