Appellant Cletis L. Crowley was charged with the offense of possession of heroin (K. S. A. 1975 Supp. 65-4127a.). After a fourth jury trial he was convicted and sentenced and he now appeals.

The prosecution evidence revealed the following. On September 27, 1973, Detective Fulton of the Wichita police department was advised by a confidential informant that heroin was being sold at a house located in the 1800 block on North Kansas street in Wichita.
