MEMORANDUM OPINION AND ORDER
HART, District Judge.
Plaintiff, Gross Common Carrier, Inc. (“Gross”), is a common and contract carrier engaged in bankruptcy reorganization proceedings in the Western District of Wisconsin and continuing in operation as a debtor-in-possession. Gross seeks $59,460.781 for undercharged transportation from shipper, Baxter Healthcare Corporation (“Baxter”), pursuant to tariffs filed with the Interstate Commerce Commission (“ICC”).
