Tampa Electric Company v. Getrost

Supreme Court of Florida

Decided October 13, 1942PublishedCited by 4 opinions

1Opinion of the Court

THOMAS, J.:

Appellee’s action to recover damages for the death of her husband, alleged to have resulted from appellant’s negligence, culminated in a verdict in her behalf. In the appeal the sufficiency of the testimony to establish liability is challenged and it is insisted that the evidence introduced by the defendant was adequate to substantiate the plea of contributory neglL gence. The only other question presented is the propriety of the trial court’s ruling in admitting certain testimony given by a man who was, at the time of the mishap, assisting the deceased, Charles G. Getrost.
