PARKER, Justice.

Indicted for the first-degree murder of Eddie Marvin Dow (“victim”) in violation of N.C.G.S. § 14-17, defendant was tried capitally. The jury found defendant guilty of first-degree murder on the theories of premeditation and deliberation, felony murder, and lying in wait. The jury also found defendant guilty of robbery with a dangerous weapon, conspiracy to commit robbery with a dangerous weapon, felonious larceny, and possession of stolen goods.
