Sarah Winchell filed suit against Brown-Walker Partnership, Stirling Properties Partnership (the owner’s leasing agent and manager of the Sharlo Apartment Complex), as well as other defendants. The petition alleged Winchell sustained damages as a result of defendants’ negligence and lack of care. Winchell asserted she had a right to recover damage under two legal theories: (1) strict liability; and (2) negligence.
