Memorandum.—Action for killing a horse. Electric wires. In the Circuit Court of La Salle County; the Hon. Dorrance Dibell, Judge, presiding. Trial by jury; verdict for defendant by direction of the court; appeal by plaintiff. Heard in this court at the May term, 1894.

delivered the opinion of the Court.

This was a suit commenced by appellant against appellee and the Central Union Telephone Company for damages suffered by appellant by reason of the alleged killing of his horse by appellee and the Union Telephone Co.

On the trial after the evidence was all in, appellant dismissed his suit against the Union Telephone Co., and on motion of appellee, the court excluded the evidence from the jury, and directed the jury to find for appellee. On the jury rendering verdict for appellee the court gave judgment against appellant for costs.…
