This cause coming to be heard on the Respondents motion to dismiss, and the parties having been heard, and the Court being fully advised in the premises:

Finds that the Claimant has received over $300,000 from various life insurers of the Claimants decedent. The terms of the life insurance policies are not determinable from the present record. The Respondent has moved to. dismiss based on the long standing precedent of this Court which holds that the State is entitled to set-off the amounts of certain recoveries.accruing to the Claimant.
