The petitioner applied for an alternative mandamus order to compel the Department of Education, to issue to him a license to practice osteopathy. The petitioner alleges that *667he was graduated from the Milwaukee College of Osteopathy on June 22, 1901, after regular attendance there as a student for three college years; that he practiced osteopathy in New York from August 18, 1901, to December, 1906, or January, 1907; and from that time on he practiced in the States of New Jersey and Vermont for a number of years, but never thereafter practiced in New York.
