*830In an action to recover damages for personal injuries, the plaintiff Nigel L. Hazzard appeals from an order of the Supreme Court, Kings County (Silber, J.), entered September 21, 2010, which denied his motion for summary judgment dismissing the defendants’ counterclaim.
Ordered that the order is affirmed, with costs.
