KYZAR, Judge.

[, This matter arose as the result of an accident involving a vehicle driven by defendant, Joseph Zeno, Jr. (Zeno), in which the plaintiff, Christy Robinette (Robi-nette), was a passenger. Defendants, Zeno and Old Republic Insurance Company (Old Republic), appeal 'from the grant of a-Motion for Summary Judgment on the issue of liability in favor of the plaintiff. For the reasons herein, we affirm the judgment of the trial court:
