LATTIMORE, Judge.

Appellant was given a sentence for five years in the District Court of Coryell County, for the murder of one Pieper.

The two men were neighbors—tenants on the same farm, used water from the same well, and worked adjoining fields.

About two years before the homicide, they had a difficulty, in Avhicli appellant made the first assault, and in which he cut deceased with a knife, and about which trouble there was the usual difference in the testimony of the State and appellant.
