The Macon-Bibb County Hospital Authority (the Authority) brought this declaratory judgment action seeking a determination as to whether it was subject to the rules and regulations of the MaconBibb County Planning and Zoning Commission (the Commission).

The facts were stipulated by the parties. In 1988 the Authority began design of a medical building to be located on Pine Street in Macon.
