In September,-1848, Talbot filed his petition in the Jefferson Circuit Court, praying for a writ of prohibition, forbidding Dent,-a- collector for the City of Louisville, to proceed further in coercing the tax assessed upon Talbot’s property in said City, for payment of the subscription of the City,- in the stock of the Louisville and Frankfort Railroad Company.- Talbot had refused-*527payment, on the ground that the statutes of the Legislature of Kentucky authorizing the subscription and taxation were unconstitutional, and the acts and…
