The testator died at Los Angeles, Cal., on October 5, 1928. His will was admitted to probate by the Superior Court of the State of California, for the county of Los Angeles, on the 86th day of October, 1988. Letters testamentary were issued to Mary Beban Smith, one of the executors and trustees named in his will, on November 7, 1928. She was also appointed on October 10, 1928, by the California court, general guardian of George Beban, Jr., testator’s only next of kin and heir at law, an infant of the age of fourteen years.
