This is an action of assumpsit against the defendants as common carriers. The material facts were these: Eagle & Co. purchased goods from Eagle, Westcott & Cambless, which were packed, marked, and taken to the defendants’ store, who undertook to deliver them to the plaintiffs, merchants living in Columbia, Lancaster county.
