OPINION

WILSON, Justice.

Appellant, Mashcon Wholesale Distributors, Inc. (Mashcon), appeals a judgment notwithstanding the verdict rendered in favor of appellee, A. Benjamini & Co., Inc. (Benjamini & Co.). We reverse and remand.

Factual Background

This case arises out of a dispute concerning the present ownersMp of certain items of formerly consigned jewelry. Mashcon, a wholesale jeweler, is owned and operated by Reuben Goldstein.
