Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered March 15, 2012, convicting defendant upon his plea of guilty of the crime of attempted, rape in the first degree.

Defendant was indicted and charged in November 2011 with burglary in the second degree and attempted rape in the first degree. Prior thereto — and having previously been indicted for failing to register as a sex offender — defendant rejected an offer to plead guilty to sexual abuse in the first degree in exchange for a prison sentence of three years followed by eight years of postrelease supervision…
