BOX, Judge:

An appeal by Kennett-Murray & Company, plaintiff, from the judgment of the trial court in an action to impress a constructive trust upon assets in an estate and for damages against the defendant bank, Pawnee National Bank.

This appeal concerns the distribution of certain funds in the estate of Nolan Dunn and Pawnee National Bank’s handling of some drafts drawn on Dunn. Dunn was a cattle buyer residing in Pawnee, Oklahoma, who bought cattle on order for various customers. Kennett-Murray is a livestock dealer in Burkville, Alabama.
