This is an áppeal by Robert Draper, hereinafter referred to as appellant, from the dismissal of. a petition for a. writ of habeas corpus.. Petition for the writ was filed in the district court for Lancaster County on October 16, 1963. On November 6, 1963, Maurice H. Sigler, warden of the Nebraska Penal and Correctional Complex, hereinafter referred to as respondent, made a return to an order to show cause why the writ should not be issued.
