BACKGROUND

[¶ 1] Plaintiff Ivan Sjovall is engaged in the feedlot business and is the owner and operator of Sjovall Feedyard located in Langford, Marshall County, South Dakota. Beginning in September of 1992, and continuing until October of 1992, plaintiff injected his cattle with certain vaccines, Bovishield 4 and Ultrabac-7/Somubac, which were formulated, compounded, manufactured, tested, marketed and recommended by defendant.
