Floyd Allen was found guilty of murder in the first degree in the Circuit Court of Wythe county, and sentence of death was passed upon him by that court on the 10th of September, 1912. At the November term of this court he presented a petition for a writ of error, in which he alleged that the trial court had made rulings prejudicial to him in the admission and exclusion of evidence, in instructions given to the jury, and in the judgment pronounced.
