The State’s attorney filed an information in the county court of McLean county on April 12, 1917, charging plaintiff in error, Vernon Elbert, in two counts, with neglecting and refusing to provide and support his wife and minor child, leaving them in necessitous circumstances. Upon a motion for support pendente lite of his wife, Imogene, and his child, the court on May 11, 1917, entered an order requiring plaintiff in error to pay $35 per month to his wife for the support of her and her minor child.
