1. The evidence sustained the verdict.
2. It was error for the court to charge that the jury must believe that the collision was an accident, beyond a reasonable doubt, before a verdict of acquittal could be returned. The true rule is that if the jury should have a reasonable doubt as to whether or not the collision was an accident, under the evidence and the defendant's statement, or either, the jury could acquit the defendant; and that if under the whole evidence, considering the defendant's statement, the jury should entertain a reasonable doubt as to the guilt of the defendant, they should…
