Appeal from an order of the Supreme Court (Dowd, J.), entered March 31, 2009 in Chenango County, which, *1219among other things, granted third-party defendant’s motion for summary judgment dismissing the third-party complaint.

Plaintiff Paul Wheeler (hereinafter plaintiff) sustained injuries when the utility pole he had climbed and was working on toppled.
