Appeals (1) from a judgment of the County Court of Tioga County (Sgueglia, J.), rendered March 13, 2009, convicting defendant upon his plea of guilty of the crime of arson in the third degree (two counts) and of violating the terms of his probation, and (2) by permission, from an order of said court, entered September 23, 2009, which denied defendant’s motion pursuant to CEL 440.20 to set aside the sentence, without a hearing.
