On January 25, 1938, plaintiff filed a statement of claim in the municipal court of Chicago and therein alleged that on July 8, 1929, and for some time prior thereto, he was employed by Roberts & Oake, Inc.; that defendant solicited him to purchase 1,085 shares, without par value, of the common stock of Roberts & Company, a corporation, at the price of $3 per share; that in consideration of such purchase the defendant then and there agreed orally with plaintiff that if at any time his employment with said Roberts & Oake, Inc. was discontinued, defendant would on demand repurchase said stock…
