This case comes before this court for the third time. Defendant appealed following his conviction by a jury for the murder of his estranged wife, Tracy Hayden, and this court affirmed defendant’s conviction. People v. Hayden, No. 5 — 91—0560 (1993) (unpublished order under Supreme Court Rule 23 (134 Ill. 2d R. 23)). Subsequently, defendant filed a postconviction petition in October 1994 and a supplemental postconviction petition in February 1995. The State moved to dismiss both petitions.
