The defendant being convicted in the Municipal Court of the city of Boston appealed to the Superior Court. The complaint charges that the defendant at Boston on June 29,1872, did keep intoxicating liquors with intent to sell the same unlawfully. At the trial in the Superior Court the Commonwealth put in evidence tending to show that the defendant on said June 29, kept intoxicating liquors in his shop with intent to sell the same unlawfully, and also evidence that on several days in June prior to the twenty-ninth he had sold liquors m his shop.
