The plaintiff’s freight agent agreed with the defendant to carry milk in cans and bottles on the plaintiff’s railroad from Carmel to Melrose Junction, both in the State of Eew York, at a rate less than the tariff rate fixed by the schedule filed by the plaintiff with the Public Service Commission and posted as required by section 28 of the Public Service Act.
