The garnishee, R. L. Sabin, one of the respondents herein, moves to dismiss this appeal upon the ground “that there is no record in the Supreme Court upon which the appeal can be predicated.” As pointed out in his memorandum brief submitted with said motion, the specific point relied upon is that on June 22, 1923, when the motion was filed, the bill of exceptions had not been filed with this court.
