The plaintiff, Dixie Metal Company, brought an action against the defendant, Crosby, in the Civil Court of Bibb County on April 9, 1969, upon which service was acknowledged by the attorney for the defendant on May 1, 1969, and answer filed on May 7, 1969. The case was called for trial on May 27, 1969, and the verdict directed for the plaintiff. Defendant filed a motion to set aside the judgment on June 22, 1970, based on the contention that the Civil Practice Act applied to the Civil Court of Bibb County and that since the defendant had 30 days in which to file his answer, the…
