Application by the Metropolitan Elevated Railway Company and the New York Elevated Railroad Company to condemn land. For former report, see 7 N. Y. Supp. 707. Laws N. Y. 1850, c. 140, § 14, requires such petitioner to.state “that it is the intention of the company in good faith to construct and finish a railroad from and to the places named for that purpose in its articles of association.”

These two several applications are made to acquire title to property, easements, or other interests referred to in the several subdivisions of the petition, and for the appointment of commissioners to ascertain and appraise the compensation to be made to the owners of, or persons interested in, the property, easements, or other interests so to be taken for the purpose of maintaining the elevated railroads in this city. Preliminary objections, and subsequently answers, were filed by nearly all of the numerous owners of property embraced in these proceedings. Many of these present the same *508quest…
