Tbe suit in tbis case was brought originally in tbe .Chancery Court of Marion County, Tennessee, by Y. A. Gaskill and bis wife, who is now tbe appellant, H. L. Whiteside.

Tbe defendants were J. C. Haselton, Tbe Bartow Iron Company, of which be was president, James P. Boyce, in bis own right and also as executor of Ker Boyce, deceased.

Tbe principal allegation of tbe bill with which we have to deal is, tbat plaintiffs, in right oí the wife, were the owners of one undivided half of certain mines, known as the Yulcan Coal Mines; that the half interest of…
