Affirming.

This litigation arose out of the purchase by the appellees, IT. W. ITighbaugh and F. D. Perkins, from the appellant, J. W. Nolan, of a house and lot situated in the town of Harlan, this state, the contract of sale being evidenced by the following writing:

“This agreement and contract made and entered into by and between J. W. Nolan of 'the 1st part -and IT. W. ITighbaugh and F. D. Perkins, parties of the second part, all of Harlan, Kentucky, this 25th day of September, 1919, witnesseth: Agreed that parties of the -second part will pay to J. W.…
