This case is before this Court upon an appeal from a final order of the Circuit Court of Kanawha County entered on November 20, 1995. The appellant, Michael D. Boxley, was convicted by a jury of the offense of murder in the first degree without a recommendation of mercy. On appeal, appellant contends that his statement to the police should have been suppressed. He also claims that the prosecution withheld exculpatory evidence.
