WICKER, District Judge.
This matter is before the Court on motions for summary judgment filed by defendants, J.K. Byrne & Co. (“JKB”), William Finegan (“Finegan”), and The North River Insurance Company (“North River”). 1 Oral argument was heard on the motions and after considering the arguments presented, the memoranda of counsel, the record, and the applicable law, IT IS ORDERED that the motions for summary judgment are DENIED.
