In this ejectment action to recover possession of demised premises both the landlord and subtenant appeal from the denial of their respective motions for summary judgment. The material facts are not in dispute.
On September 9, 1975 plaintiff leased the entire 16th floor of 151 West 40th Street to defendant Printsiples for use and occupancy as an executive and sales office, as well as a showroom for the sale of textiles, for a 10-year term commencing October 1, 1975 at an annual rental of $18,000.
