delivered the opinion of the Court.

Tfiis action was brought originally before a justice of the peace of Sumner county, by the defendant in error, and from a judgment against him he prosecuted an appeal to the circuit court of the county, and in that court a judgment was rendered in his favor. The bank then prayed an appeal to the court of civil appeals, and there the judgment of the circuit court was affirmed. The case was then brought to this court by the writ of certiorari.
