Appellants (“Residents”) appeal from the district court’s dismissal of their complaint for lack of jurisdiction and failure to state a claim upon which relief could be granted. Residents’ claims against the Environmental Protection Agency (“EPA”) were premised upon the Clean Air Act (“CAA”), 42 U.S.C. § 7401 et seq. (1982), the Resource Conservation and Recovery Act of 1976 (“RCRA”), 42 U.S.C. § 6901 et seq. (1982), and the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. § 9601 et seq. (1982). We affirm in part, and…
